What You Should Do To Protect Your
Claim:

You don’t have to hire a lawyer right away. There are many advantages, and no
disadvantages, to doing so however. But whether or not you hire a lawyer early
take these steps to not prejudice your case:

1) Do not speak to the other party’s insurance claims
representative. They are trained to get you to say things that will minimize
their insured’s liability and your eventual monetary award. The claims rep is not
your friend.

(2) Do not talk about your accident on social media. Insurance companies are
savvy about the value of admissions on social media and mine Facebook daily.

(3) Do not sign a release allowing the other party’s insurance representative
access to your medical records. They will use the release to get medical
records having nothing to do with your accident. PROTECT YOUR PRIVACY!

(4) Do collect photos of the accident scene, your vehicle and your injuries.

(5) Do save copies of all your medical bills, medication bills, lost wage
information, and cost of support services such as laundry and house cleaning.

Of course, if you hire a lawyer specializing in the representation of injured
accident victims, he or she will help you with all of the above. Another
important fact: generally the statute of limitations in the State of California
is now two years from the date of the accident or injury causing event. There
are some important exceptions: if a governmental entity is involved, you have
only six months to provide them detailed written notice of your claim. And in
medical malpractice cases the statute of limitations is only one year from the
date of knowledge of injury.

Don’t sit on your rights. You may lose your opportunity to seek justice if you
wait. Most, if not all, personal injury attorneys do not charge for the initial
appointment and represent clients upon a contingent fee.

What is a contingent fee?

This is a fee conditioned upon some event. Generally
speaking, the attorney agrees to represent you and advance all costs of
litigation upon the agreement that you will reimburse the attorney’s costs from
case proceeds and pay the attorney a set percentage of the trial or settlement
award at the conclusion of the case. No recovery, no fee.

Please call us to establish a free consultation appointment. If you are house
or hospital bound Mr. Boroff will be happy to meet you there and explain the
process further.
